Chapman Spingola Secures Summary Judgment Against Restrictive Covenants

Bob Chapman, Sara Siegall and Bob Shapiro successfully represented a client against his former employer who sought to have the Circuit Court of Cook County enforce a variety of restrictive covenants against him.

After the trial court found the covenants unenforceable as a matter of law, the Illinois Appellate Court affirmed in a widely-reported opinion.

“The Appellate Court’s published decision makes clear that Illinois courts, in this post-Reliable Fire world, will still strike down facially overbroad restrictive covenants as a matter of law and will decline an employer’s after-the-fact request to ‘blue pencil’ patently unenforceable restraints so that they comply with Illinois law,” said Bob Chapman.
